1. Introduction and Acceptance

Welcome to LearnStories. These Terms of Service ("Terms") govern your use of the LearnStories mobile application and website at learnstories.ai (the "Service"), operated by ZYAGA LLC ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. Age Requirement

You must be at least 13 years of age to use LearnStories. By using the Service, you represent and warrant that you meet this age requirement.

If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Account Registration

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access to your account

3.2 Account Responsibilities

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain the security of your account credentials.

4. Subscription Terms

4.1 Subscription Tiers

LearnStories offers multiple subscription tiers including Free, Reader, and Creator plans. Current pricing and features for each tier are displayed within the app and on our website. Prices are subject to change with reasonable notice.

4.2 Billing and Auto-Renewal

  • Paid subscriptions are billed in advance on a monthly basis
  • Subscriptions automatically renew unless cancelled before the renewal date
  • You will be charged at the beginning of each billing period

4.3 Cancellation

You may cancel your subscription at any time through:

  • Your Apple App Store account settings (iOS)
  • Your Google Play Store account settings (Android)
  • Your account settings on our website (web subscriptions)

Cancellation takes effect at the end of your current billing period. You will retain access to paid features until then.

4.4 Refunds

Refund requests are handled by the respective payment provider:

  • iOS purchases: Contact Apple App Store support
  • Android purchases: Contact Google Play Store support
  • Web purchases: Contact Stripe or the payment processor used

We defer to app store and payment provider refund policies. We do not process refunds directly.

5. AI-Generated Content

5.1 Content Ownership

All AI-generated content created through the Service, including stories and images, is owned by LearnStories. This includes:

  • Story text generated by our AI systems
  • Images generated to accompany stories
  • Any derivative works created by the AI

5.2 License to Users

We grant you a limited, non-exclusive, non-transferable license to:

  • Read and access stories you generate through your account
  • Share public stories with attribution to LearnStories
  • Use generated content for personal, non-commercial language learning purposes

You may not:

  • Sell, license, or commercially distribute AI-generated content
  • Remove LearnStories attribution from shared content
  • Claim ownership of AI-generated content

5.3 Content Moderation

AI-generated content is created using third-party AI services and is not reviewed by LearnStories before display. Such content is subject to OpenAI's usage policies and content guidelines. The Service will:

  • Block generation of inappropriate, harmful, or illegal content
  • Automatically moderate generated content
  • Remove content that violates these Terms or applicable laws
  • Remove content in response to valid copyright or intellectual property complaints

We reserve the right to review, modify, or remove any generated content at our discretion.

6. Acceptable Use Policy

6.1 Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree to use the Service only for personal language learning.

6.2 Prohibited Conduct

You agree not to:

  • Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Attempt to generate content that sexualizes minors or promotes violence
  • Use the Service to harass, bully, or intimidate others
  • Circumvent usage limits or restrictions on your subscription tier
  • Use automated scripts, bots, or scrapers to access the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Share your account credentials with others
  • Create multiple accounts to circumvent limits or bans
  • Interfere with or disrupt the Service or servers
  • Violate any applicable local, state, national, or international law
  • Generate content featuring copyrighted characters, trademarked properties, or intellectual property you do not have rights to
  • Attempt to create content that infringes on the intellectual property rights of third parties

6.3 Reporting Violations

Users may report inappropriate public content or policy violations by contacting us at info@learnstories.ai.

7. User-Generated Content

7.1 Public Stories

If you make a story public, you grant us a worldwide, non-exclusive, royalty-free license to display, distribute, and promote that content within the Service.

7.2 Content Responsibility

You are solely responsible for any content you submit, including story prompts and profile information. You represent that you have all necessary rights to such content.

7.3 Content Visibility

User-generated content, including stories and images created through the app, may be visible to other users if you choose to make it public. You are responsible for deciding what content to share publicly.

8. Third-Party Services

The Service integrates with third-party services including Supabase, RevenueCat, OpenAI, Apple, and Google. Your use of these services is subject to their respective terms and policies.

9. Account Termination

9.1 Termination by You

You may delete your account at any time through the app settings or by contacting us at info@learnstories.ai.

9.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if you:

  • Violate these Terms or our Acceptable Use Policy
  • Engage in fraudulent or illegal activity
  • Abuse or harass other users or our staff
  • Circumvent subscription limits or payment systems

9.3 Effect of Termination

Upon termination:

  • Your right to use the Service will immediately cease
  • You will lose access to your account and data
  • We may delete your data in accordance with our Privacy Policy
  • Any outstanding subscription fees remain due

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF CONTENT

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • AI-generated content will be accurate, appropriate, or suitable for any purpose
  • Defects will be corrected
  • The Service is free of viruses or harmful components

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEARNSTORIES AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL
  • ANY DAMAGES RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE
  • ANY DAMAGES RESULTING FROM AI-GENERATED CONTENT

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless LearnStories and our affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your infringement or alleged infringement of any intellectual property rights, including copyrights and trademarks
  • Content you submit to the Service

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to conflict of law principles.

13.2 Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Ohio, USA. You consent to the personal jurisdiction of such courts.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on this page
  • Updating the "Last Updated" date

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and LearnStories regarding your use of the Service and supersede any prior agreements.
